Apple Wins Copyright Infringement Case

Apple’s efforts to stop a Florida company from selling PCs preloaded with its Mac Leopard operating system have been successful.

A judge has ruled that Apple’s copyright infringement claim against Psystar has merit. Psystar had countersued, arguing that Apple was misusing its copyright claims. The judge tossed out the countersuit.

Apple’s claim was that Psystar violated several exclusive rights it holds for its OS X, including right to reproduction and distribution. Psystar had previously claimed that Apple was a monopoly; that argument was thrown out a year ago.

Another court hearing has been set for Dec. 14 to determine what remedies there are now that the ruling has been made. Apple has made a handful of other claims – including trademark infringement and breach of contract – that will have to be addressed then as well.

Apple’s biggest battle over its products might be with Palm. Apple has spent months doing its best to keep Palm Pre users from syncing their Pres with iTunes.
