Comcast Seeks Court Overturn of FCC Throttling Order

08/14/2009

Comcast Corp. (CMCSA) has asked a federal appeals court to overturn the FCC’s 2008 net neutrality order.

The agency last year instructed Comcast to halt “discriminatory management practices” by the end of 2008 or else. But Comcast insists the FCC overstepped its bounds.

If the court sides with Comcast, that will mark a coup for ISPs that fear the FCC order could affect their business as well.

In late 2007, Comcast came under consumer fire – and subsequent government scrutiny – for throttling peer-to-peer traffic, namely from BitTorrent.
